§ 9-6-13. Discharge Prohibited.
A person shall not discharge or cause to be discharged any of the following described waters or wastes to any public sewers:
(a)
Any flammable or explosive liquid, solid, gas, or any substance which may create a fire or explosion hazard in the POTW including but not limited to gasoline, benzene, naphtha, fuel oil, wastestreams with a closed-cup flashpoint of less than one hundred forty (140) degrees Fahrenheit or sixty (60) degrees Celsius using the test method specified in 40 C.F.R. 261.21.
(b)
Any waters containing pollutants, toxic or poisonous liquids, gases or fumes in sufficient quantity, either singly or by interaction with other wastes, to injure or interfere with or pass through any waste treatment process, constitute a hazard to humans or animals, cause acute worker health or safety problems (i.e., having pollutant concentrations exceeding screening levels for fume toxicity), create a public nuisance, or create any hazard in the receiving waters of the wastewater treatment plant.
(c)
Any waters or wastes having pH lower than 5.0 or higher than 10.0 or otherwise having any other corrosive property capable of causing damage or hazard to structures, equipment, and personnel of the wastewater works.
(d)
Solid or viscous substances in quantities or of such size capable of causing obstruction to the flow in sewers, or other interference with the proper operation of the wastewater facilities such as, but not limited to, ashes, bones, cinders, sand, mud, straw, shavings, metal, glass, rags, feathers, tar, plastics, wood, unground garbage, whole blood, paunch manure, hair, fleshings, entrails, paper dishes, cups, milk containers, etc., either whole or ground by garbage grinders.
(e)
Any wastewaters, liquid, or vapor having a temperature higher than one hundred forty (140) degrees Fahrenheit.
(f)
Any trucked or hauled waste or wastewater containing pollutants, except at discharge points designated at the POTW.
(g)
Any wastewater whose pollutant level exceeds applicable National Categorical Pretreatment Standards.
(h)
Any bypass of waste or wastewater except where the bypass is unavoidable to prevent loss of life, personal injury, or severe property damage. The industrial user shall notify the City immediately in the event of a bypass.
(i)
Any dilution of a wastewater discharge as a partial or complete substitute for adequate treatment to achieve compliance with a pretreatment standard or requirement.
(j)
Any medical/infectious wastes, pharmaceutical waste, or radiological waste except as specifically authorized in a discharge permit.
(k)
Household hazardous wastes including, but not limited to, paints, stains, thinners, pesticides, herbicides, antifreeze, transmission and brake fluids, motor oil and battery acid.
(l)
Any hazardous waste listed or designated by DES under Env-Wm 400.
(m)
Any discharge into the POTW of a substance that, if otherwise disposed would be a hazardous waste under 40 C.F.R. part 261 or are hazardous wastes as defined in the NHDES Hazardous Waste Rules, is prohibited unless permitted by applicable State of New Hampshire and federal permits, and that is also approved by the EPA Regional Waste Management Division Director.
