Article 15-10. GENERAL LICENSING ORDINANCE |
§ 15-10-11. Right of Appeal.
Any person aggrieved by any decision of the Licensing Officer shall have the right to appeal to the Licensing Board by filing a written appeal with the City Manager within three (3) business days following the effective date of the action or decision complained of.
(a)
Contents of Appeal. The appeal shall set out a copy of the order or decision appealed from and shall include a statement of the facts relied upon to avoid such order together with any defenses, legal objections or explanations which the appellant wishes the Board to consider.
(b)
Notification of Licensing Officer. At the time of filing the appeal, a copy thereof shall be filed by the appellant with the Licensing Officer.
(c)
Hearing. The City Manager shall fix a time and place for hearing the appeal and shall serve a written notice, as provided herein, upon the appellant informing him thereof. The City Manager shall also give such notice to the Licensing Officer and the Officer shall be entitled to appear to defend such order.
(d)
Effect of Decision. The findings of the Licensing Board shall be served upon the appellant as required herein.
